2. PURPOSE AND ACCEPTANCE OF THE LEGAL TERMS

2.1.- In compliance with the provisions of Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (LSSICE), the present provisions govern the access and use of the service of the Website https://www.unobike.com, (hereinafter the "Website") that IMPORT EXPORT BIKE S.L.U (hereinafter UNOBIKE.COM) makes available to Internet users.

2.2.- The purpose of the Website is to inform, promote and offer for sale the products and/or services offered by UNOBIKE.COM, which reserves the right to modify at any time and without prior notice, the presentation, configuration and location of the Website, as well as the contents, products and/or services exposed therein.

2.3.- Access, registration (if any) and use of the Website and other services confers the status of User and is subject to compliance with these Legal Terms (or “Legal Notice”), the General Contracting Conditions and the particular ones that specifically regulate the services offered by UNOBIKE.COM, which the User declares to know and accept expressly and integrally, from the moment they access the Website and the aforementioned services, the moment at which they also acquire the status of User of the same. To this end, the User is recommended to carefully read the conditions and instructions set out on the web pages each time they access them, as well as the need to reload at all times the contents that are in the cache memory of the User’s own computer in order to receive fully updated information

2.4.- Consequently, any use of the Website implies acceptance, without reservations of any kind, of these Legal Terms regardless of the access to the Website where the User is, the User being obliged to read them on each of said accesses.

3.1.- These Legal Terms, the General Contracting Conditions, the Particular Conditions established, as well as any particular conditions that may eventually be established, and with the wording they present at any given time, have an indefinite duration, and shall remain in force as long as the Website continues to be active.

3.2.- Likewise, the access and use of the Website and the resources and services it offers have, in principle, an indefinite duration, although UNOBIKE.COM reserves the right to suspend, interrupt and/or cancel, unilaterally and at any time, access to the Website, or to any of its parts and/or resources, without prior notice and without this generating any right to claim by the User.

4. MODIFICATION REGIME

4.1.- UNOBIKE.COM reserves the right to unilaterally modify, totally or partially, at any time and without prior notice, both these Legal Terms, the General Contracting Conditions, the Particular Conditions, the configuration, presentation and design of the Portal or any of the elements and services that integrate it; the general or specialised information, and the contents provided and, in general, any other circumstances not expressly designated, including the cancellation of the Website or any of its elements.

4.2.- Once any of the aforementioned modifications have been implemented on the Website, all subsequent access by the User shall imply their unconditional acceptance of the same.

4.3.- Likewise, in order to offer a correct operation of the Website, UNOBIKE.COM reserves the right to temporarily suspend, and without the need for prior notice to Users, the accessibility to the Website and its services in the event of carrying out maintenance, repair, updating or improvement operations of the services, information and contents, as well as to modify or update the conditions of access to the Website.

6. CONDITIONS OF ACCESS AND USE

6.1.- Access to the information of the different products and services existing on the website, as well as simple browsing shall be free and gratuitous, and therefore Users shall not be required to register with the consequent delivery of their personal data, possession of passwords or payment of a price.

7. WARRANTY AND LIABILITY REGIME

7.1.-Without prejudice to the rest of these General Terms, the General Contracting Conditions, the established Particular Conditions or any particular conditions that may eventually be established, the User is informed that their own use of the Website, as well as of the information, services and contents that form part of the Website, is their sole and entire responsibility, releasing and leaving UNOBIKE.COM fully harmless from any liability and damage against UNOBIKE.COM for such use by the User.

7.2.- Likewise, the User is informed that in the event of the following assumptions or circumstances, UNOBIKE.COM shall be exempt from liability, except in case of wilful misconduct or bad faith of UNOBIKE.COM, namely:

The damages that the User may suffer due to the lack of availability, punctuality or functioning of the Website of all or some of its elements, information, services, contents, etc., or due to the lack of truthfulness or accuracy of any of them or due to error.

7.6.- UNOBIKE.COM does not guarantee the continuity of the operation of the Website, its contents and services, nor that they are always operational and available. Likewise, UNOBIKE.COM is not responsible for the damages that may arise from, on a merely enunciative and non-limiting basis:

7.8.- UNOBIKE.COM does not guarantee that the links, which may eventually exist and which in any case are merely informative, to other web pages (“links” or “frames”) are accurate and correct at the time the User of the Website decides to use them. UNOBIKE.COM shall not assume any kind of damage, loss or any kind of damage, direct or indirect, arising from the information, opinion, contents, applications, products and/or services that may be offered or displayed on the web pages that are the responsibility of third parties or collaborators unrelated to UNOBIKE.COM, which, where appropriate, would have been accessed through the links included on the Website and its services.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1.- The User acknowledges and accepts that all trademarks, trade names or distinctive signs, all industrial and intellectual property rights, on the contents and/or any other elements inserted on the page, are the exclusive property of UNOBIKE.COM and/or third parties, who have the exclusive right to use them in economic traffic. In no case does access to the Website imply any type of waiver, transmission, license or total or partial assignment of said rights, unless expressly established otherwise. By virtue of the provisions of the Intellectual Property Law, the content on the Website may not be reproduced in whole or in part, nor transmitted, nor registered by any information recovery system, in any form or by any means, unless prior written authorisation is obtained from UNOBIKE.COM.

If any provision of the aforementioned conditions is considered invalid or unenforceable, said provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these conditions shall remain in full force and effect.

13. APPLICABLE LAW AND JURISDICTION

13.1.- These Legal Terms and the established Particular Conditions or those that may eventually be established are governed by Spanish legislation.

13.2.- In the event of a dispute or controversy related to the application or interpretation thereof, the parties shall submit to the Courts and Tribunals that are territorially competent in accordance with the current legislation.

14. ENTIRE AGREEMENT AND TERMINATION

14.1.- These Legal Terms, the General Contracting Conditions, the established Particular Conditions or those that may eventually be established, as well as our Privacy Policy, constitute the entire and exclusive agreement between UNOBIKE.COM and the User in relation to the Website, and these rules supersede and replace any previous agreement between the User and UNOBIKE.COM regarding the Website.
